The Action Peoples Party, APP, has on Wednesday, withdrew the petition it filed to nullify the declaration of Asiwaju Bola Tinubu of the ruling All Progressives Congress, APC, as winner of the 2023 presidential election.
At the resumed sitting, Counsel to the APP, Mr. Obed Agu brought a motion for withdrawal and urged the court to strike out the suit having been withdrawn.
Following the No-Objection stance by the respondents on the matter, Justice Haruna Tsamani dismissed the petition.
Speaking with journalists after the proceedings, Mr Obed Agu, maintained that he was fully ready to argue the petition to the end but acted strictly on the instructions of his client.
The withdrawal of the petition of the APP has brought the number of petitions before the Presidential Election Petitions Court to three.
They are the Peoples Democratic Party, PDP, the Labour Party, LP, and the Allied Peoples Movement, APM.
Meanwhile, the court would hear the petition of Mr. Peter Obi and his party by 2pm today.
